On 18 November 2024, the new EU Product Liability Directive (Directive (EU) 2024/2853) was published in the Official Journal. It will enter into force twenty days after publication and must be transposed into national law by 9 December 2026 – in Germany through a new Product Liability Act. This fundamentally modernises European product liability law, which has been in force since 1985, and adapts it to the digital age.
This means new liability provisions, extended obligations and amended rules on the burden of proof. Among other things, software and digital design files (e.g. CAD files) will also be covered in future. The circle of liable economic actors is growing significantly, and the previous liability limits and deductibles for property damage are being eliminated. In addition, the statute of limitations for long-term health damage that cannot be claimed within the maximum period of ten years is being extended to up to 25 years.
For quality management, this means that processes, testing strategies and documentation must be designed to meet the expanded requirements – from development to the supply chain to after-sales. Those who respond early can reduce liability risks and at the same time strengthen trust among customers and authorities.

Significant parts of the services provided by ProduktionNRW are funded by the Ministry of Economic Affairs, Industry, Climate Protection and Energy of the State of North Rhine-Westphalia.
